We would like to update you about the following matters.
Lawsuit
First of all, the Dutch anti-piracy organization BREIN has announced to begin a full proceedings lawsuit (Dutch terminology: ‘bodemprocedure’) against Mininova. BREIN demands that we implement a filter on Mininova and take responsibility to prevent possible copyright infringements being taken place by our users. We discussed this matter with BREIN for a long time, but we couldn’t agree as their demands are both disproportionate and invalid.
The lawsuit will likely take several years and will take place in Utrecht, The Netherlands. Our case will be defended by Christiaan Alberdingk Thijm of KaZaA fame and VIta Zwaan. We will proceed to court with full confidence, and defend our unique position in the BitTorrent world and our current copyright policy. The court decision will be important for many other community-driven websites, like Google and YouTube.
As a side note: please know that we do not provide user information to third parties. For you as a Mininova user, nothing will change for now. More press coverage: English or Dutch.
5 billion downloads
In other news: we passed the mark of 5 billion (5,000,000,000) torrent downloads yesterday. The previous mark, 4 billion downloads, was reached in February this year. TorrentFreak has full coverage on this story.

well mininova isnt really a site that abuse copyright infrigment only those who upload stuff are the ones who done illegal stuff. but really the only thing i deem illegal at all are media that been recently brought to the public been upload without letting the company 1 year to sell their product from retails store without having the product upload here. hell if people did that then the company hardly get the funds to make more of their product. but if its illegal to torrent old games that are like around 2000 then the law for it is bull crap.
they have to defend their copyrights, and try to put sites like this out of business. If they open there arms and willing embrass sites like this, they’d be doomed. i wouldnt work at mc donald’s for free. just because work goes into something a bit more abstract doesnt mean it needs to be unpaid. that said, i’m going to enjoy watching season 6 of curb your enthuasim i got off this site today; something i cant go out and spend the $40 or so dollars to buy (but own previous seasons) anyways, good luck, and godspeed. Stick by your guns; principals can be hard and expensive to defend

I agree that it’s stealing to dl most things via mini and other bitTorrent sites. Corporate greed aside, there are also plenty of good folks working to create or sell media who are losing out, as pointed out by ben.
Phish’s business model was pretty great. I could get instant gratification by downloading a show for a reasonable price within 24 hours after the show, directly through the Phish website.
Taking that analogy to movies, I’d definitely pay to dl a decent quality flick that’s just been released if I don’t have the time, budget or inclination to get to a movie theater. Iron Man, on day one at the local movie house was way fun.
Downloading, file sharing and a black market will always be around. So the studios will have to innovate and drive solutions to take that volume (5 billion!!) and change technologies and business modelss so that it works for everyone.
Anyhow, just some thoughts there. As with everyone else, here’s a toast to mininova! Get that legal defense fund link up there soon.

An early reply suggested sending $1 from every downloader thus generating 5 billion dollars. Political contributions to the appropriate elected officials’ re-election coffers might produce a valid ‘legal’ solution. For those thinking this constitutes bribery, what do you think all those contributions from the media industry to political organizations and candidates are? Hmmm first INCONCEIVABLE! 5 billion. Wow! It really is a great site. Interestingly, I’m writing a book on strategics having to muse over the hypocrisy of copyrighting my own stuff while infringing upon others. If I were to have a nice and neat resolution to that dilemma then one would be sure that the conscience is “no wider in breadth” than a mote of dust. I beg to differ with some of the comments in a world where liberal propaganda often passes for truism. One is surprised by how much propaganda stains one’s own perceptions. The US economy is a global economy, with Wall Street being a heavy player. The problem with information propagation and control is an economic strategic matter for shareholders world-wide. Therefore it makes sense for the Dutch to protest and launch infringement suits when US citizens don’t buy copyrighted material from that place. Every country has share-holding elites that don’t want to see Microsoft or Adobe stock threatened. It’s easy to imagine that the top 1% of the world that own 50% are the one’s pushing the buttons. So let’s get real about this. One easily tires of blaming the US for everything and holding the average person responsible for the actions of elites. Since when does the average serf dictate economic policy? The problem anywhere, is that elites can run their countries into the ground -then run off somewhere else with their fortunes -then ruin that place. Look to your elites and try to remember how much influence you really have over them before putting the onus on something considered more tangible.
I very rarely leave comments on forums or discussion board because to be quite frank most of the comments i do read are from completely misinformed idiots. I use Mininova quite regularly to download the odd piece of software and don’t feel hugely bad about it because i feel corporations such as Apple and Microsoft will continue to make money from the plethora of financially rewarding investments that they are a part of. Conversely, music piracy is killing the music industry and if removing file sharing sites reduces music piracy to an absolute minimum and allows talent to be continued to be invested in from record and publishing companies then i fully support it. People complain about the costs of CD’s but what they fail to understand is that the average cost of writing, rehearsing, recording, producing, marketing, touring and pressing an album is often in the realm of £500,000. By the time artists sign a deal they have often been working for 4 years self promoting, developing and running up debts often up to £20- £30k. As you can see from the figures, if an artists sells just 60,000 copies of an album, the label recoups and after A&R, producer and management percentages, they may see £60k for their work, less the £30k debt and then split say between 4 band members, each getting £7.5K. Selling 60,000 copies of an album is very very hard and still the musician only receives an annual salery of less then someone working in McDonalds. So next time you torrent an album, please consider that not only are you downloading the creative work of which probably spans 3 years of hard graft you are also reducing the chance of the artists ever being able to afford to live from his talent and therefore continue to release music. This my friends is why the consumer market is saturated with over produced commercial music that is meaningless and formula written – not because record companies revel in releasing shite music, but because the industry is in rapid decline and cannot afford to make investments or take risks in real bands and musicians, thus rely on making quick guaranteed income from repetitive mediocre pop. Musicians can no longer afford to live from making music they love. Everyone raves about how wonderful Myspace is and that you can have millions of people accessing your songs, but it does not pay the bills. I’ve probably not explained this as well as i could because its 2 am and most people will probably just call me a dick head for going against the majority, but my point is that if we want to have more music from classic bands and artists in the future, we need to stop ripping them off. If you don’t pay for music, it will just be a downward spiral, so think about it.

As for this company Brein to be honest they don’t have a leg to stand on to be honest. Firstly most cases of downloads of films etc are usually thrown out of court.
There is no issue in regards to downloading a film etc as long as you don’t sell for profit. Most of todays music is crap! I only listen to the stuff from 50s and 60s so it’s not hurting the music industry on that front as it’s not new.
Brein will be the ones hit at the end of the day, losing the battle and having to pay thousands in court fees.
