We would like to update you about the following matters.
Lawsuit
First of all, the Dutch anti-piracy organization BREIN has announced to begin a full proceedings lawsuit (Dutch terminology: ‘bodemprocedure’) against Mininova. BREIN demands that we implement a filter on Mininova and take responsibility to prevent possible copyright infringements being taken place by our users. We discussed this matter with BREIN for a long time, but we couldn’t agree as their demands are both disproportionate and invalid.
The lawsuit will likely take several years and will take place in Utrecht, The Netherlands. Our case will be defended by Christiaan Alberdingk Thijm of KaZaA fame and VIta Zwaan. We will proceed to court with full confidence, and defend our unique position in the BitTorrent world and our current copyright policy. The court decision will be important for many other community-driven websites, like Google and YouTube.
As a side note: please know that we do not provide user information to third parties. For you as a Mininova user, nothing will change for now. More press coverage: English or Dutch.

In other news: we passed the mark of 5 billion (5,000,000,000) torrent downloads yesterday. The previous mark, 4 billion downloads, was reached in February this year. TorrentFreak has full coverage on this story.

Brein’s lawsuit is nothing but an “harrasment-suit”, they stand no chance in winning it, but they want to slow you guys down with legal prcedures and possibly drive you to bankrupcy with the legal fees (Vita Zwaan & Christiaan A. Alberdingk Thijm don’t come cheap). May I suggest you start a Pay Pal Donate specifically for the legal fees? I also agree with earlier comments about donating. There are some amount of people on this site geting free stuff almost every day, are we really that greedy that we couldn’t all give $1 or $5 to the cause, cuz we will all miss it if it goes. Its the best torrent site out there at the moment. Come on people, a pay pal account needs to be set up by Mininova and a once off fee for everyone to help them, which also helps us. $5 is a third of price of a cd, which over time we have all saved a lot thanks to Mininova. I wish you all the best against the big companies, but sadly money is their middlename and they also can solve anything in court based on technicalities. The skill to misinterprit the law books in a way that any law there could be used for them and not against them is what settles their good lawyers world apart from bad ones. But atleast I hope the battle will be long and mininova continues to grow while it’s going. Could be, but there’s some serious brainwashing coming from people in power and media is their method at getting you and that has seriously changed how many people see websites as mininova. You gotta know there’s some serious pirating going on irc and newsgroups which they can do nothing about, all they can try to do is attack the biggest websites they can find, probably the most useless and money costing fight in history. That money should be spent on trying to find cures for diseases or something, anything but this! Also it’s common knowledge that people who know more than media can pick their sides freely, other “popular choice following mass people” can’t, thus I wouldn’t care too much of their opinions when obviously it’s others making opinions for them. Media itself has clearly picked their side (can’t say for every country, but it seems it’s the same everywhere), and that’s the side of money so they support the artists and labels etc. Proof enough is that I rarely see anyone defending for filesharing on TV, but it’s full of interviews of artists who complain they’re losing money because of all the pirating, when in fact their labels are still getting by well and they’re probably losing money because of many other reasons, for the massive growth of gaming industry so people spend much more money on games than they used to spend on music and stuff like that. That just tells how money hungry all the music labels, movie studios and game companies are, they even gotta invade your home just to get their point cross.
I know myself I wouldn’t buy any more stuff I’m buying right now (limited money you see) so I’d just be having less. So only one who would be affected by my pirating is me, that obviously means all the artists and defenders of labels are wrong when they they tell that they’re losing money because of my pirating. I don’t want to limit myself nor do I let anyone else to do it for me, so therefore I download stuff. I don’t steal it nor do I buy or claim to own it, I just use it. It’s like lending from a friend, friend called mininova

the reasoning of BREIN that by downloading artists are missing income is not true. I would not buy a DVD or CD for the current high prices. Period.

i got to say, i love this site=)
minonova is the best ever, usally clean and everything, and most of the moderators are the coolest ever =P but sice i cant send a complaint anywhere so i will tell it here. downloaded a torrent that a few said was virus infected and many icluded the moderator said was clean.
but when i installed it i got a virus warning, i use McAfee and it said i just got a tojan in my system, that really pissed me of. i have trust to the moderators but i feel a little dissapointed.
Hey with 5 billion downloads you should have enough power to fight the courts. In a democracy, the people’s vote counts and if the people think that copywright laws are a thing of the past, they are.

I use your site to promote Christian music. Most of the songs are free of any copyright.
I would gladly donate to a continue the fight fund. This is the greatest site in the whole world. I have spent thousands of dollars by cd’s and dvd’s which I have very few left. I have had to pawn them when in hard times which by the way they give so little now you would have to pawn at least a hundred to cover the gas to get there. I have also figured that the quality of the cds are so poor now that you listen to them 2 or 3 times and they have scratch and start skipping so you have to buy another. Then you have the theft issues when someone else feels they need it more than you. Bottom line you as a consumer could easily buy 1 cd 12 times a year at least just to have one could copy that seems a little expensive to listen to a little good music. Yet they want to come down on everyone about sharing when I know everyone who likes music as much as I do just wants to have it to listen to without skips or just whenever the mood hits you. They did not ever raise any stink about the cassette we all bought and copied from and for friends they also lasted longer.
Final thoughts - I love mininova it has aloud me get get back all they music I have lost and some I never could afford to get. Fight them all the way and if money is an issue set-up the paypal donations every visitor and sharer would be glad to donate at least 1 dollar a month even to continue this great site. Thanks alot

I think that the problem with the piracy comes down to those who want to make a quick pound selling stuff they have downloaded (not even obtained themselves - downloaded and re-re-plagiarized) I have and never will sell anything i get on here - and if I really really like it then i will buy it!

Yes, 5 billion is an impressive number. But what everyone seems to be overlooking is the fact that BTing works because it’s seen as illicit and countercultural by the majority of the population. The more people that are doing it, the less revenue there is for the developers and publishers. Less money to go around means fewer projects will be funded, and publishers will retreat back to their known moneymakers (ie major artists and sequels).
My point is that an increasing popularity in BTing is not necessarily a good thing. And because of this, a major and highly publicized victory in court would create the perception among many that don’t already BT that it is OK to do so, which would ultimately damage the community. So, personally, I’m hoping for a major QUIET victory in court.

we are all doing something illegal when downloading (something which doesnt keep me from sleeping at night, i couldnt give a shit) but if the guys at mininova get fukced over this court case than all filesharers should own up to there wrongdoing and offer to go to jail!!! lol i’d love to see governments around the world trying to handle the sudden increase inmates (im presuming at least 5000-10000 in a country of 4 million) they’ll be shitting themselves!!!

Fight the fight. I ONLY started to use this site when coperate greed and corporate polotics interfered with my prefered viewing. I had a contract with a cable TV supplier who were showing my favourite TV shows. One of their suppliers (mentioning NO names but something to do with what we see when we look upwards) decided to increase their fees for suppling their programs for distribution by my supplier to such an exhorbitant amount that neither party could agree on an equitable deal. I am STILL paying as if I was receiving that channel and a few others. Therefore I believe that I have the right to continue watching those programs. So therefore the royalties are still being paid. Those royalties are just not being collected by the people that should be getting them. As further mittigation, as soon as the DVD’s are available for that (or those) series’s I do buy them (when I have the money available). As is so often said, If the film makers were not so greedy and if they released them earlier then more people would buy them AND they would make more money.

Aside from ideology, it might be time to look into filters. Many countries are starting to take Internet copyright infringement seriously and could just as easily block sites altogether. So you might win the battle to allow free posting only to be blocked by countries looking to enforce copyright.
And even if you do win you could wind up with huge legal debts. The major entertainment companies could easily justify spending millions on lawyers if they felt it would save them even more money.
Remember, at one time even hacking was tolerated but no more. Captain Crunch went to jail.
I would like to see torrents developed as a way to distribute and develop more legal material. It would be a shame for them to be shut down over the illegal stuff.

KaZaA is shit and is well known for viruses, at least on mininova the torrents are checked by the moderators and are safe to use, and the torrent name is actually what you get. I can remember trying to get Van Helsing before it’s release date, and when I downloaded it on KaZaA, i got dutch porn!…..
