Hey all, good news!
In December last year we blogged that “mininova” turned out to be the 9th most Googled word. We wrote back then:
It’s good to see our site between the top-10 most popular search terms, but it probably also means the homepage of Mininova is not very trivial to find. We promise you we’re going to work on this issue next year!
One of the main reasons that so many people search on Google for Mininova, is that we use the “.org” TLD instead of the (more common) “.com”. So why not simply register Mininova.com?
The problem was that this domain was already registered by a scammer. This person was using the domain to trick people into paying money (up to 100$) to access our website. This technique is usually refered to as phishing. As a result, we received hundreds of emails from people who submitted their credit card information to this scammer.
Fortunately that’s all over now. In January, we hired the law firm Traverse Legal and started a domain dispute against “Atlas Protecta Co. Ltd.”, which is an alias used by the scammer. The decision came out a few days ago, and can be read here.
The arbiter judged that our three assertions were valid:
- The domain name registered by Respondent is identical or confusingly similar to a trademark or service mark in which Complainant has rights; and
- Respondent has no rights or legitimate interests in respect of the domain name; and
- The domain name has been registered and is being used in bad faith.
To put a long story short, Mininova.com is now ours and redirects to the “.org” site 
A short note to the people who lost money to the scammer: please contact your local bank and ask for a refund of the credited amount of money.

so what’s the big deal here? I think that’s great personally, luckily we live in countries where we can debate this.
but reality check here, the end user is the one responsible for the legality of their actions, not some guys that admin an awesome site.

i’d say mininova actually at least clearly pronounces their views that they would co-operate fully if kiddie porn was discovered.
heck, I think these guys are pretty top notch, and if someone searched for kiddie porn, they would probably voluntarily report the info to the appropriate authorities in their country.
I don’t think even google as expressly makes this moral argument as mininova has.
You can use google to get pirated stuff – no way! people are finding this site through google, so if any of those users pirate anything, google is just as responsible as mininova in facilitating access to “illegal” materials. People used google to find pirated stuff long before mininova, even before torrents, ever heard of IRC? Newsgroups? FTP? These things are still around, just as torrents will be down the road. People used search engines before google to find pirate materials, and mininova is a search engine, just like google as a concept. Since the concept doesn’t explicitly deny illegal materials, no search engine is really any more responsible than another. If a search engine only came up with illegal results, that’s a different story. In this case you are arguing with fallacious logic, and it looks as though you are trying to stir up the pot in some attempt at generating publicity.
Piracy of digital “things” have different laws in each country. Torrents are not illegal by concept, and I would argue that you could break copyright laws pretty quickly with either google or mininova.
Mininova facilitates access to legitimate content just as google does. Google and mininova comply with different laws regarding any illegitimate content, although google as a company operates their entire concept across servers in many countries, whereas mininova’s servers are located in the Netherlands, and their continued operation (and indeed, success) suggests that they are adequately complying with local laws.
Perhaps the only real issue here is that of societies themselves and whether or not people comply with their countries laws, or have morality that directs them to act in a way that happens to be in accordance with the laws.
Mininova only facilitates access to .torrent files, where Google facilitates access to all sorts of content. Google is a corporation, and as such has certain responsibilities to each country they operate in. Torrents, are a medium where individuals are gathered with files that can be shared amongst users, and each individual has their own motivation to comply, or not, with the laws of their country – not the guys who made the search engine, which linked to sites where there may have been questionable content under some copyright laws.Google and Mininoval each have legal and illegal uses;what you do with google, or mininova, is your responsibility, your conscience, and potentially, your life if you get caught violating the associated laws in your country.
That being said, I think that this site and torrents as a concept are great and I certainly won’t be losing any sleep over the hundreds, even thousands of gigabytes of torrented data i’ve transferred.The legality of digital things is still sufficiently murky and far too complex for the average individual to figure out, and quite frankly, I just don’t give a f*ck about it myself. As a whole entire world of many countries, there are far more pertinent issues than how much more rich some corporations are are getting…

I’m afraid this is outright false. It is copyright infrigement and it is illegal. There are international treaties in place for this. The reason that “licensed material” is being treated specially in the anime fansub world is that the fansub groups (generally) don’t sub/spread licensed anime since they want to help it be more commercially viable. It is still illegal.
Now, once again in the anime world, the reason people aren’t hunted down is (one can assume), that spreading something outside of japan that otherwise wouldn’t have been spread outside of japan does not deprive the authors of any money and therefor does not provide enough of an incitement to actually go after anyone.
To reiterate: it’s still illegal, and they could in theory at any time decide to start going after people, fansubbers and downloaders.
I myself think that copyright law should be heavily revised, so I’m not saying this to discourage anyone (as if it that was possible anyways
, just to try to correct this misunderstanding.
We can’t argue for a change in copyright law if we don’t know how it works.
(local variations in copyright law might apply :p)

By making that argument of morality and legalities public… on a website that a fool can recognize as being a beautifully grey zone for file sharing (which is a hideously grey topic of discussion)…did “bullshit” think his message would be positively received by users of the services provided by Miek? Whether either party could even begin to prove themselves more “right” than the other is futile already, and a joke if you ask me, but the sad part is that the only parts of that conversation that carried any real validity was the transparent motives of each and every snide and biting response. The winner of the lawsuit was rejoicing, the loser, or the sympathizer of the loser (and yes, I do enjoy calling him that), was whining like a desperate child. Both sides were trying so hard to back their stories up with fact that the entire argument was lost in translation.
Nobody here gives a fast flying fuck about whether big-business protecting organizations like EUCD or DMCA have feelings for any of the business conducted by (excellent) services provided… the only real concern to the people reading this nonsense is whether or not we’ll have decent rips of excellent media.
